This course is designed to be an introduction to the legal reasoning employed by members of the judiciary in the decision-making process. Hopefully, it will initiate students in understanding the methods used by judges in arriving at judicial opinions that may affect all aspects of our lives. We will discuss all types of law considered by members of both the state and federal judiciary in arriving at their decisions, both preliminary and plenary. When studying the judiciary we will consider the immediate decisions that are made by trial judges as well as the reviewing process conducted by the appellate courts. We will also consider the common law, stare decisis, statutory enactments and the constitution and the affect each of these law making procedures have on the ultimate judicial decision-making process. Furthermore, we will discuss the legal and judicial philosophy of both trial and appellate judges that help them in arriving at their conclusions as to pending litigation.
